LEGAL TESTS FOR LURC REVIEW OF
PLUM CREEK’S MOOSEHEAD CONCEPT PLAN
According to the LURC law, Plum Creek’s Moosehead concept
plan:
• must be consistent with the Comprehensive Land Use Plan (CLUP)
for the unorganized areas
• must satisfy a demonstrated need in the community or area
• must have no undue adverse impact on existing uses or resources
• must be more appropriate for protection/management of existing
resources than the current zoning
According to LURC’s Comprehensive Land
Use Plan (CLUP) and regulations, Plum Creek’s Moosehead concept
plan:
• must protect natural resources (air, soils, forests, lakes,
rivers, wetlands, wildlife and fisheries)
• must protect cultural resources (archaeological and historical)
• must protect recreation resources
• must protect scenic resources
According to the LURC regulations, Plum Creek must
present substantial evidence that its Moosehead concept plan:
• will not adversely affect natural and cultural resources values
• will have no undue adverse impact on water quality and lake
management goals
• will have no undue adverse impact on traditional uses (non-intensive
public recreation, sporting camp operations, timber harvesting, etc)
• will have no undue adverse impact on regional diversity and
natural character
• has enough conservation to justify waiving the normal requirement
that new development be adjacent to existing development in order to
avoid sprawl
• strikes a reasonable and publicly beneficial balance between
appropriate development and
long-term conservation
