Maine Court Rejects Stay in Atlantic Salmon Federation Dam Case

LAW STREET JOURNAL • April 1, 2022

On Wednesday, the United States District Court issued an order in the case of Atlantic Salmon Federation Us et al. v. Merimil Limited Partnership et al., granting the environmental group plaintiffs’ request for a 60-day deadline extension and denying the defendants’ motion to stay the case. The plaintiffs filed the original complaint on September 9, 2021, against the licensees and managers of four dams located on the Kennebec River. They argue that the four dams at issue are harming Atlantic Salmon populations in the Kennebec River in a manner constituting a taking in violation of the Endangered Species Act.
